No charges will be filed against a West Price Hill store owner who shot and killed an alleged robber, Hamilton County Prosecutor Joe Deters said Thursday, adding that she was “clearly justified.”
The woman, who WLWT is not identifying, said “I fought for my life.”
She said she is still rattled by the incident and is locking the doors between customers.
The incident took place on Jan. 23, when Cincinnati police were called to the Glenway Pony Keg on Glenway Avenue for reports that someone had tried to rob the store.
Deters said that the store owner shot and killed a gunman who pointed a gun in her face during a robbery.
“As long as I’ve been prosecutor, I’ve said this repeatedly: If you go into a store with a gun and rob it, you forfeit the right not be shot,” Deters said.
The prosecutor showed video of the incident, in which the gunman entered the store, went behind the counter and demanded money from the store owner.
He threatened to kill her multiple times, Deters said.
“He said, ‘I’m going to kill you.’ He said it constantly: ‘I’m going to kill you.'”
The gunman, later identified as 48-year-old James Douglas, had a loaded gun, Deters said, but he had failed to chamber the first round.
Douglas was shot twice, in the chest and the back, Deters said.
The police located two firearms at the scene. They found a loaded 9 mm Springfield Arms which Douglas brought to the scene and a Ruger .380 semi-automatic owned by the store owner.
Deters said the store owner had a concealed carry license.
