A Sacramento woman has put a family home on the market and she wants the realtor to ensure that it isn’t sold to a supporter of President Donald Trump.

The home has been in Linda Morgan’s family for decades, and although she told the local CBS affiliate that she is open to people from all walks of life, Morgan says that openness stops at political preference.

Attorney Allen Sawyer told the network that he believes the stipulation to be illegal. “That’s an unlawful contractual term that infringes the freedom of association and first amendment rights. People have a right to believe what they want to believe and they shouldn’t be restricted from purchasing property based on that.”

The Fair Housing Act lists “race, color, national origin, religion, sex, disability and the presence of children” as reasons homeowners are prohibited from refusing to sell or rent, but it does not mention political preference.
