His out is going to be that it wasn’t ‘pending’ in September 2 when the text from the FBI officials said “Obama wants to know everything” about the Clinton case. It would, of course, be inappropriate in any event and they shouldn’t be briefing him even if it wasn’t pending, which it may still have been, as Comey said he never really closed it.
