The Alabama secretary of state said Thursday he will certify Democrat Doug Jones as the winner of a Senate race despite an eleventh-hour lawsuit filed by Republican Roy Moore claiming that election fraud affected the “outcome of the election.”

Jones defeated Moore, whose campaign was dogged by allegations of past sexual misconduct, by 22,000 votes in the Dec. 12 special election.

Moore has refused to concede and on Wednesday his campaign sued to block certifying Jones as the winner.

But Secretary of State John Merrill said the suit won’t have any bearing on the outcome.

“Will this affect anything? The short answer to that is, no,” Merrill told CNN during an interview on Thursday.

“Doug Jones will be certified at 2 ​p.m. Eastern Time, 1​ ​p.m. Central Time​,” he added. “We will sign the documents certifying him as the senator for the state of Alabama. He will be sworn in by Vice President Pence on the 3rd of January when the Senate returns.​”​
