Cruz has won all the citizenship cases filed so far, some on procedural grounds, others on the merits of the case, as in this case.

GOP presidential candidate Ted Cruz just got some good news for his campaign about running on the ballot in Pennsylvania.

A court case that claimed Cruz was not eligible for the presidency because he was born in Canada has been tossed out.

According to NBC New York:

Texas Sen. Ted Cruz has won a case in Pennsylvania’s highest court that had challenged his eligibility to appear on the state’s GOP primary ballot and serve as president.

The state Supreme Court order Thursday upheld a lower-court judge’s decision to dismiss the case.

A Pittsburgh resident and registered Republican voter, Carmon Elliott, had argued that Cruz isn’t eligible to run for president or to appear on Pennsylvania’s April 26 primary ballot because he was born in Canada.

The case was dismissed because Judge Dan Pellegrini argued that Cruz’s mother has always been a U.S. citizen, and that it didn’t matter if he was born in Canada, as long as she is an American, according to how common law works.

Since Cruz’s run for the White House, people have argued he isn’t eligible to run because he was born in Canada. Perhaps the news of the judge’s ruling will put those theories to rest.
