The criminal case against state Sen. Virgil K. Smith, who is suspected of firing numerous shots at his ex-wife’s car early Sunday morning, has been sent back to Detroit police for additional investigation, the Wayne County Prosecutor’s Office said this afternoon.

Smith was arrested on suspicion of aggravated assault with a gun and malicious destruction of property following the incident outside his home on Detroit’s east side, Police Chief James Craig announced this morning.

Those charges have not been formally authorized by the prosecutor’s office. A warrant request police sent to prosecutors was returned, requesting further investigation, the Prosecutor’s Office said in a news release. Smith remains in police custody, a police department spokeswoman said.

“We have not treated this case any differently than others that involve domestic violence,” Craig said.

Smith has been cooperative with police, Craig said.

The incident occurred about 1 a.m. Sunday at the home near 7 Mile and Ryan roads, and Smith was later brought in for questioning. He remains in custody.

Craig said that this is the only contact he knows of between his department and Smith. Sunday’s incident is the only time police have been called to the address in 2015, police confirm.

Craig said police recovered a weapon as part of the investigation, but he said police don’t know whether it’s the weapon used, and he declined to specify the type of gun. He said 10 shots hit the car.

According to the police sources, the shots were fired at a Mercedes belonging to Smith’s ex-wife. She was not injured.

Another police source told the Free Press a woman in her 30s called 911 about 1 a.m. saying a man fired shots at her and that her car had been struck. The source, who did not have authority to speak publicly about the investigation and requested anonymity, said the shooting occurred outside Smith’s home on the 18600 block of Wexford on the city’s north side.

Police spokeswoman Cassandra Lewis declined to release details because the incident was considered a domestic matter. She said a person called police to report being shot at, and that the person suspected of firing the gun was not at the home when police arrived.
