The opening of alleged Boston Marathon bomber Dzhokhar Tsarnaev’s trial was in the hands of a federal appeals court Friday night, with the starting date and venue uncertain just two days before hundreds of potential jurors are set to arrive at the federal courthouse in South Boston.
The US Court of Appeals for the First Circuit was considering a last-minute request by Tsarnaev’s defense team to postpone next week’s scheduled jury selections and relocate the trial to a federal court outside Boston.
The defense lawyers also asked, as an alternative, that the appeals court order the trial judge to hold a hearing on disputes relating to a consultant’s report on the jury pool.
Either scenario would effectively upend the schedule for Tsarnaev’s highly anticipated trial, forcing a delay of at least two months.
It was not immediately clear Friday how the appeals court would handle the request, which was filed as an emergency petition Wednesday.
