Police are investigating a double shooting in Avondale. Chief Jeffrey Blackwell said the shooting was gang-related and he believed it was in retaliation to another shooting that happened in the same area over the weekend.
In a news release, Prosecutor Joe Deters said he is asking the First District Court of Appeals to dismiss a case he brought before the court because the subject of the case was killed last month.
Tywaune Thomas died Aug. 20, a day after police said he shot Antwon Ward to death on Carplin Place. Thomas was shot by someone else after shooting Ward, Deters said, though police have previously told media that Ward and Thomas shot each other.
According to Deters, Thomas was in front of Judge Tracie Hunter in October 2013 for sentencing on a charge of aggravated trafficking in drugs.
The Hamilton County Juvenile Court Probation Department recommended commitment to a secure facility of Department of Youth Services (DYS), and Deters’ office concurred, as Thomas had 36 prior convictions.
Deters said Thomas had a history of escaping non-secure facilities and violating electronic monitoring.
Deters said Hunter refused to place Thomas at DYS and made orders regarding attending out-patient treatment, school and work, plus put him on EMU. Deters’ office appealed the decision, and it was to go before the Court of Appeals on Monday.
If Thomas had been committed to DYS, Deters said, he could have remained in a secure facility until age 21.[…]
Hunter, a Democrat who took the bench after a lengthy legal battle over disputed election results, has said she is being targeted for political reasons.
The Ohio Supreme Court disqualified her in January from acting as a judge after an indictment alleged that she backdated court records and misused a county credit card, among other allegations.
