White House Deputy Senior Advisor David Simas claimed 3.9 million “learned they are eligible for coverage through Medicaid and the Children’s Health Plan because of the Affordable Care Act”. This was, as we have come to learn with most things from this regime, untrue. Many of these alleged people who “learned they were eligible” were already participants in Medicaid and were simply renewing.

Not only did Simas lie, but as Megyn Kelly noted, the President’s twitter account, @BarackObama, included this false number in the claim of “6 million signed up”, reinforcing the lie, and punctuating it at the end with “that’s a fact!”. No it isn’t, it’s a “material misrepresentaion” of the facts, in Megyn’s legal terms. That’s usually the language indicating actionable fraud. The six million includes the falsely inflated 4 million for Medicaid and the supposed 2 million regular sign ups (which includes people who haven’t actually paid).
